Auction Enquiries
Enquiries about estimates and other matters can only be made up to
6:00pm on the Thursday before the auction.
Faxed and e-mail bids (please include your name, address and telephone number) are acceptable up to
10:00pm on
the Thursday before the auction.
Security at our Auctions
Bags and large coats are not allowed in the viewing areas. Many of the items can only
be viewed under steward supervision. Other security
surveillance will be in place.
Privacy Policy
Should you request information from us your data will only be used for
the purpose for which it was provided. We will only use the information
we collect about you with your consent to answer your request. We will
never wilfully disclose personal information about you to any third
party without first receiving your permission or unless we are under a
legal obligation to do so.
Buyer to Collect
Some very large items are marked in the catalogue as
BTC Buyer
to Collect. These items must be collected from us or one of the events
that we attend.
Auction Terms and Conditions
1. All persons attending a Sale under the conduct of the Auctioneers
shall be deemed to be on the land and premises at their own risk and
shall have no claim against the Auctioneers in respect of the
cancellation/postponement of a Sale or any loss, accident or injury,
however occasioned, save in so far as the same is proven to be caused by
the direct negligence of an employee of the Company.
2. The Auctioneers make every effort, with the help of experts where
possible, to ensure the accuracy of advertisements, catalogue
descriptions and other publicity but declare that all statements, oral
or in writing, are those of opinion only, made without responsibility
and shall not give rise to any action in law for damages, compensation
or rescission of a sale by a purchaser, against any vendor, the
Auctioneers or their employees.
3. Many lots are of an age or nature which preclude their being in
pristine condition. Some catalogue descriptions may make reference to
damage and/or restoration; however, omission of such a reference does
not imply a lot is free from defects nor does any reference to a
particular defect imply the absence of others.
4. Ample time is given for the inspection of the lots and purchasers
should therefore satisfy themselves by physical inspection of lots,
before bidding, as to the origin, authenticity, quality, age, weight,
size and general description as lots are sold in their actual state with
all faults, imperfections or error of description.
5. Persons handling lots do so at their own risk and shall make good all
loss or damage however sustained, such costs as assessed by the
Auctioneers, whose decision shall be final.
6. Lots are sold subject to any announcement, declaration, alteration of
description or other matters, made by the Auctioneers prior to the
auction of any Lots.
7. At the fall of the hammer, the highest bidder, acceptable to the
Auctioneers, shall be the Purchaser and any dispute shall be settled by
the Auctioneers, whose decision shall be final. Auctioneer’s Discretion
may be exercised when a lot reaches within approx 10% of the reserve
price and there are no other bids either from the room or on commission.
8. Unless prior arrangements have been made with the Auctioneers,
cheques in excess of the recognised limits will not be accepted from
purchasers unknown to them who have not previously supplied a Bank or
other suitable reference. In all cases, cheques must be supported by a
valid Bank Card. Non compliance with this condition may delay the
release of lots pending the clearance of cheques.
9. We accept valid credit and debit cards in payment for items bought at
the auction but we will levy a commission charge of 3% (in addition to
all other charges) for credit card purchases. No charge is made for
debit card purchases. Once the transaction confirmation is received
goods may be collected.
10. If, within seven days of the Sale, a person gives notice in writing
to the Auctioneers that in his/her opinion a particular lot is a
deliberate forgery and provides evidence of the same, then the
Auctioneers will rescind the transaction and refund the purchase price
received by them.
11. Commission bids are accepted free of charge but only if confirmed in
writing on the pro forma in the catalogue or from our website. Lots will be purchased for
commission bidders at one step up from the highest bid in the saleroom.
12. A Buyer’s Premium of 10% (including VAT) will be raised on all items
at the time of settlement.
13. The commission rate to vendors is as shown on the Auction Entry Form
which must be completed when entering items for auction. A charge of 10%
(plus VAT) of the RESERVE PRICE (minimum £5.88 inc. VAT) will be charged
on all items withdrawn from sale for whatever reason.
14. The Company and Derbyshire County Cricket Club reserves the right to
refuse admission to the auction venue to any person without necessarily
giving a reason.
